  1. LIMITED WARRANTY AND DISCLAIMER OF WARRANTY

  3. This software and accompanying written materials (including
  4. instructions for use) are provides "as is" without warranty
  5. of any kind. Further, QualiType Software does not warrant,
  6. guarantee, or make any representations regarding the use, or
  7. the results of use, of the software or written materials in
  8. terms of correctness, accuracy, reliability, currentness, or
  9. otherwise. The entire risk as to the results and performance
  10. of the software is assumed by you. If the software or written
  11. materials are defective you, and not QualiType or any of its
  12. dealers, distributors, agents, or employees, assume the entire
  13. cost of all necessary service, repair, or correction.

  15. The above is the only warranty of any kind, either express or
  16. implied, including but not limited to the implied warranties
  17. of merchantability and fitness for a particular purpose, that
  18. is made by QualiType Software, on this QualiType product. No
  19. oral or written information or advice given by QualiType, its
  20. dealers, distributors, agents or employees, shall create a
  21. warranty or in any way increase the scope of this warranty and
  22. you may not rely on any such information or advice. You may
  23. have other rights which vary from state to state.

  25. Neither QualiType Software nor anyone else who has been
  26. involved in the creation, production or delivery of this
  27. product shall be liable for any direct, indirect,
  28. consequential or incidental damages (including damages
  29. for loss of business profits, business interruption, loss
  30. of business information, and the like) arising out of the
  31. use or inability to use this product even if QualiType has
  32. been advised of the possibility of such damages.

  34. This Limited Warranty shall be governed and construed in
  35. accordance with the laws of the State of Michigan, United
  36. States of America.

  38. ACKNOWLEDGMENT

  40. By using the "Special Edition" (or "SE") version of any
  41. QualiType Software computer program, you acknowledge that
  42. you have read this limited warranty, understand it, and
  43. agree to be bound by its' terms and conditions. You also
  44. agree that the limited warranty is the complete and exclusive
  45. statement of agreement between the parties and supersedes all
  46. proposals or prior agreements, oral or written, and any other
  47. communications between the parties relating to the subject
  48. matter of the limited warranty.
